Welcome to Klassikerkollen! These Terms of Use ("Terms") govern your use of our website and mobile applications (iOS/Android) (collectively, the "Service"). The Service is provided by Kotte Consulting AB (Reg. no. 559195-0802).

By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

1. The Service & Disclaimers

Klassikerkollen is a comprehensive digital platform designed to optimize your journey through "En Svensk Klassiker". The Service includes features such as:

• Progress Tracking: Aggregating training data to track progress toward official diplomas.
• Performance Analysis: Improvement predictions, race time predictions, seeding group calculations, and "Superklassiker" feasibility analysis.
• Logistics & Planning: Race-day checklists, energy planning, and event-specific weather insights.

Important Disclaimers:

• Intended Use: The Service is for personal, recreational use only. It is not a medical device.
• Health Warning: Endurance sports involve physical risk. Always consult a doctor before starting a new training program. You use the Service and participate in training activities at your own risk.
• Algorithmic Coaching Disclaimer: The "Personal Training Plan" and coaching insights are generated by algorithms based on general data patterns. They do not take into account your specific medical history, current injury status, or daily physiological changes. You must listen to your body first. If the app suggests a workout that feels wrong or painful, ignore the app.
• Prediction Disclaimer: Features like "Race Time Prediction" and "Seeding Calculator" are theoretical estimates based on historical data and your inputs. They do not guarantee actual race results or start group assignments, which are determined exclusively by the race organizers.

2. Beta Services

During the "Closed Beta" or "Open Beta" phases (including distributions via TestFlight or Google Play Console), the Service is provided for testing and evaluation purposes. You acknowledge that:

• The Service may contain bugs, errors, or inaccuracies.
• We may reset your data or change features significantly without notice.
• The Service is not yet intended for production use where data integrity is critical.
• We rely on your feedback to improve the product, but we are under no obligation to implement specific feature requests.

3. User Accounts

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. Data and Third-Party Integrations

Our Service integrates with third-party platforms like Garmin Connect and Polar Flow.

• Authorization: By connecting a third-party account, you authorize us to retrieve and process your activity data as described in our Privacy Policy.
• Service Availability: We rely on third-party APIs (Garmin/Polar) to provide the Service. We are not liable for service interruptions, missing data, or functionality issues caused by outages or API changes on their end.

5. User Data License & Algorithm Training

While you retain ownership of the specific data you submit (e.g., your race times and heart rate data), you grant Kotte Consulting AB a non-exclusive, royalty-free, perpetual license to use such data for the following purposes:

• Service Delivery: To display your personal stats, graphs, and logistical plans within the app.
• Aggregated Analysis: To create anonymized, aggregated statistics that do not identify you personally.
• Model Training: To analyze, evaluate, develop, and improve our machine learning models and algorithms (e.g., race time predictors). We use anonymized data for this purpose.

6. Data Integrity & Fair Play

To maintain the integrity of our tools and any community features, we reserve the right to remove specific activity data if we have reason to believe it is manipulated, incorrect, or misleading (e.g., recording a car ride as a run).

7. Intellectual Property

All rights, title, and interest in the Service (including software, design, checklists, predictive models, and algorithms) belong to Kotte Consulting AB. You acknowledge that any improvements to our models derived from your usage data become the exclusive property of Kotte Consulting AB.

8. Subscription and Payments

Some features of the Service may require a paid subscription ("Premium").

• Fees: Subscription fees are billed in advance on a monthly or annual basis.
• Platform Billing: If you subscribe via the Apple App Store or Google Play Store, your subscription is managed by that platform. You must manage cancellations and refunds directly through your Apple ID or Google Play account settings. We cannot process refunds for purchases made through these stores.
• Cancellation: You may cancel your subscription at any time via your account settings. The cancellation will take effect at the end of the current billing period.

9. Limitation of Liability

To the maximum extent permitted by law, Kotte Consulting AB shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service (e.g. loss of data or missed race goals). The Service is provided "as is" without warranties of any kind regarding reliability or availability.

Specifically, we are not liable for any issues caused by third-party service providers (e.g., internet providers, Garmin API outages, or cloud hosting failures) that are outside our control.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden. Any disputes shall be settled by Swedish courts.
